1. Acceptance of Terms
By creating a reservation, using, or attempting to use the Town of Ponce Inlet, Florida (“Town”) athletic court reservation system (“System”), you agree to be bound by these Terms of Service (“Terms”), as well as all applicable Town ordinances, policies, and posted facility rules. If you do not agree to these Terms, you may not use the System or the municipal athletic courts.
2. Scope and Definitions
2.1 “Athletic courts” include, but are not limited to, pickleball, tennis, basketball, and other hard‑court facilities owned or operated by the Town.
2.2 “User” or “you” means any person or entity that accesses the System, makes a reservation, or uses the athletic courts under a reservation.
2.3 These Terms govern your use of the System and the athletic courts reserved through it, in addition to any posted or published facility‑specific rules.
3. Eligibility and Accounts
3.1 Eligibility to reserve courts may be limited to residents, property owners, guests, or other authorized users as defined by Town policy. Proof of eligibility (such as identification or proof of residency) may be required at any time.
3.2 Users must provide accurate and complete information when creating or using an account or submitting a reservation. The Town may cancel reservations or suspend access to the System if it determines that information provided is false, incomplete, or misleading.
3.3 Users are responsible for maintaining the confidentiality of any login credentials associated with the System and for all activities that occur under their accounts.
4. Reservations and Use of Courts
4.1 Reservations are required where indicated by Town policy or the System. Walk‑up use may be allowed when courts are not reserved, subject to posted rules and staff direction.
4.2 The Town may establish limits on:

How far in advance reservations can be made.

The maximum number or length of reservations per user per day, week, or month.

The maximum number of concurrent or overlapping reservations.
4.3 Users must begin and end play within their reserved time and promptly vacate the court at the end of the reservation to avoid interfering with subsequent users.
4.4 The Town reserves the right, in its sole discretion, to modify, reassign, or cancel reservations at any time, including for maintenance, Town programs, special events, weather, safety concerns, or other municipal purposes. When practicable, the Town will attempt to notify affected users using the contact information on file.
4.5 Users are responsible for verifying their reservation details and any cancellations or changes before arrival.
5. Cancellations and No‑Shows
5.1 Users must follow any established cancellation procedures and timelines as set by the Town (for example, a minimum number of hours before start time). Failure to cancel in accordance with Town policy may result in penalties, including temporary suspension of reservation privileges.
5.2 Repeated no‑shows, late cancellations, or misuse of reservations may result in suspension or revocation of System access and court reservation privileges.
6. User Conduct and Facility Rules
6.1 All users must:

Comply with all posted rules at the facility.

Comply with all applicable Town ordinances and regulations.

Follow directions given by Town staff, law enforcement, or authorized representatives.
6.2 The following activities are prohibited unless expressly authorized in writing by the Town:

Commercial or for‑profit use, including paid lessons, clinics, or events.

Organized tournaments, leagues, or special events not approved by the Town.

Vandalism, graffiti, or damage to Town property.
-
Harassment, threats, or disruptive behavior toward other users, staff, or neighbors.

Possession or use of alcohol, tobacco, vaping products, or illegal substances where prohibited by law or Town policy.

Bringing glass containers, unsafe equipment, or any items specifically prohibited by posted rules.
6.3 Users must maintain reasonable noise levels, respect surrounding properties, and comply with posted park or facility hours.
6.4 The Town may immediately terminate play, cancel reservations, and/or remove users from the facility for violations of these Terms, posted rules, or Town ordinances.
7. Responsibility for Minors and Guests
7.1 Adults who reserve courts are responsible for the conduct and safety of minors in their care and for any guests who use the courts under their reservations.
7.2 All minors must be supervised as required by Town policy and posted rules.
8. Assumption of Risk
8.1 Use of athletic courts involves inherent risks of injury, including but not limited to slips, falls, collisions, and injuries resulting from physical activity and interaction with other players.
8.2 By reserving or using the courts, users voluntarily assume all risks associated with their participation and agree to take reasonable precautions for their own safety and the safety of others, including using appropriate footwear and equipment.
9. Liability and Indemnification
9.1 To the extent permitted by Florida law, the Town of Ponce Inlet, its officials, employees, volunteers, and agents are not liable for any personal injury, death, property damage, or loss of personal property arising from or in connection with the use of the System or the athletic courts, except as required by law.
9.2 Users are responsible for any damage they, their guests, or minors in their care cause to Town property and may be billed for repair or replacement costs.
9.3 Nothing in these Terms shall be construed as a waiver of the Town’s sovereign immunity or the limits of liability set forth in section 768.28, Florida Statutes, or any other applicable law.
10. System Use, Data, and Public Records
10.1 Users must not misuse the System, including but not limited to:

Creating false or fraudulent reservations.

Using automated tools to make or hold reservations.

Sharing accounts in violation of Town policy.
-
Attempting to interfere with or disrupt the System’s operation.
10.2 Reservation and account information may be stored and used by the Town for operational, planning, and enforcement purposes.
10.3 Users understand that information submitted through the System may constitute public records subject to disclosure under Florida’s public records laws, unless exempt or confidential under Florida law.
11. Privacy
11.1 The Town may collect and use personal information provided through the System (such as name, contact information, and reservation history) for purposes related to court management, communication with users, and compliance with applicable laws.
11.2 The Town will manage such information in accordance with applicable Florida law and Town policies regarding records retention, disclosure, and privacy.
12. Changes to Terms and Policies
12.1 The Town may update or modify these Terms at any time. Updated Terms will be posted on the Town’s website or within the System and are effective upon posting unless otherwise stated.
12.2 Continued use of the System or the courts after changes take effect constitutes acceptance of the revised Terms.
13. Suspension and Termination of Access
13.1 The Town may suspend or terminate a user’s access to the System and reservation privileges, temporarily or permanently, for any of the following reasons, including but not limited to:

Violations of these Terms or posted facility rules.

Abuse, harassment, or threats toward staff or other users.
-
Repeated no‑shows, late cancellations, or misuse of reservations.

Fraudulent or deceptive conduct.
13.2 The Town may exercise this authority in its sole discretion, consistent with applicable Town policies and laws.
14. Governing Law and Venue
14.1 These Terms are governed by the laws of the State of Florida and the ordinances and regulations of the Town of Ponce Inlet, Florida.
14.2 Any legal action or proceeding arising out of or relating to these Terms, the System, or the use of the athletic courts shall be brought in a court of competent jurisdiction located in Volusia County, Florida, subject to any applicable requirements of Florida law.
15. Questions, Concerns, and Contact Information
15.1 Users with questions or concerns about reservations, facility rules, or these Terms should contact the appropriate Town department (for example, Parks and Recreation or Town Clerk).
15.2 Contact information, office hours, and designated email addresses or phone numbers will be published on the Town of Ponce Inlet’s official website and may be updated from time to time.
16. Severability
If any provision of these Terms is determined to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.
17. No Waiver
Failure of the Town to enforce any provision of these Terms on any occasion shall not be construed as a waiver of the Town’s right to enforce that provision or any other provision on any other occasion.
18. Acknowledgment
By using the System or the athletic courts under a reservation, you acknowledge that you have read, understand, and agree to be bound by these Terms of Service, subject to review and modification by the Town’s legal counsel.
